Environmental Due Diligence

AllWest provides accurate, timely information and reviews to concerned parties on environmental issues in real property due diligence investigations for acquisitions, dispositions, re-financing, leasing transactions and loan work-outs.

The purpose of conducting an ESA is to assess the subject site for conditions indicative of releases or threatened releases of hazardous substances on, at, in or to the property resulting from its current, historical and surrounding land use activities.

Soil, Soil Vapor, Indoor Air Quality and Groundwater Investigations
AllWest routinely conducts subsurface investigations which assess soil, soil vapor, groundwater quality and follow-up indoor air quality assessments. AllWest manages 10 - 15 soil and groundwater investigation/case closure projects annually.

San Francisco: Maher Zone Compliance
In 2013 the City of San Francisco enacted legislation enlarging the area where mandatory soil and groundwater testing is required prior to site redevelopment activities. Commonly referred to as the expanded Maher Zone, properties throughout the City that (1) have the potential to contain hazardous substances, based on site histories that indicate prior use for industrial uses, gas stations, or any other uses associated with underground storage tanks or located within 100 ft. of any properties containing underground storage tanks, and (2) properties located within 150 feet of freeways. For such sites the property owner must prepare a land use history (Phase I ESA) and submit the findings to the San Francisco Department of Public Health (DPH) for review. DPH will require soil testing and/or groundwater investigation where appropriate. DPH will also require remediation where the investigation indicates the presence or absence of any one of the materials designated by DPH as hazardous.

AllWest has significant project experience assisting clients comply with Maher Zone (SF Health Code Article 22A & SF Bldg Code Article 106A.3.4.2) requirements. Recent and former projects include sites on West Portal, Brannan, Harrison, Bryant, Market, Folsom, Howard, Turk, Leavenworth, 7th, 2nd, Green, Mission, Front, Tennessee, Shipley, 24th Street, 16th Street and Page Street.
